Emergency legislation prohibits immigration detention in structures not originally built for incarceration, setting up potential Supremacy Clause challenge
I strongly support this emergency legislation as well as Howard County's, but how did the HoCo facility get to the point of construction without the 180 day public notice and two hearings? Or was that just part of the regular permit process and no one noticed?
Essentially, the government couched it as a GSA general "detention center," and not an immigration detention center as outlined in the Dignity not Detention Act. Once the county discovered ICE was behind the contract, they moved to terminate the permits.
Got it. Sadly, that does not surprise me that they would do that. The date on the original application was 09/27/2024? So this was started under Biden? That's disappointing, but I guess also not surprising.
So much of this goes back years, sadly. And in the course of our investigations, we’ve talked to a number of people at different levels of government who can confirm that ICE has essentially been a rogue agency since the first Trump administration.
